1. Munchor Market is a marketplace, not a food preparer

Munchor Market ("Munchor," "we," "us") operates an online marketplace that connects customers with independent food vendors, home cooks, private chefs, bakers, and caterers ("Vendors"). Every Vendor on the Foodhall is an independent business. Munchor does not prepare, cook, handle, package, store, inspect, transport, or deliver any food sold through the Foodhall. Each order you place is a direct transaction between you and the Vendor, processed through the Vendor's own checkout.

2. Home kitchen disclosure

Many Foodhall Vendors prepare food in private home kitchens operating under state cottage food or home-based food business laws. Home kitchens are typically not inspected or licensed by state or local health authorities to the same standard as commercial food establishments, and in some jurisdictions may not be inspected at all. By ordering through the Foodhall, you acknowledge and accept that the food you purchase may have been produced in a kitchen that is not subject to commercial health inspection.

3. Assumption of risk & limitation of liability

To the fullest extent permitted by law, Munchor Market disclaims all liability for, and you assume all risk relating to: food quality, safety, freshness, preparation methods, storage, handling, ingredients, labeling accuracy, allergen exposure or cross-contamination, foodborne illness, injury, or any other harm arising from food purchased from a Vendor through the Foodhall. Munchor makes no warranties, express or implied, regarding any Vendor or any food item. Your sole recourse for issues with an order is with the Vendor who prepared and sold it.

4. Allergen warning

⚠️ Foods sold through the Foodhall may contain or come into contact with milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy, sesame, and other allergens. Home and shared kitchens present a higher risk of cross-contact. Ingredient lists provided by Vendors may be incomplete. If you have a food allergy, intolerance, or dietary restriction, contact the Vendor directly before ordering. Do not rely solely on product descriptions.

5. Vendor responsibilities — cottage food law compliance

⚠️ Vendors: before listing or selling any food on the Foodhall, you are solely responsible for confirming that your products and operations comply with all applicable federal, state, county, and municipal laws, including but not limited to:

  • Cottage food registration, permits, or licenses required in your state or locality;
  • Permitted food types — most states limit cottage food sales to non-perishable, shelf-stable items and prohibit the sale of perishable / temperature-controlled (TCS) foods (meats, cooked plates, dairy-based items, etc.) without a commercial kitchen license or food establishment permit;
  • Labeling requirements, including required cottage food disclosure statements, ingredient lists, and allergen declarations;
  • Annual gross sales caps that apply to cottage food operations in many states;
  • Sales channel and delivery restrictions — some states restrict online sales, interstate shipping, or third-party delivery of cottage foods;
  • Food handler training or certification where required;
  • Tax registration, collection, and remittance obligations.

Cottage food laws vary significantly by state and change frequently. Verify current requirements with your state department of agriculture or local health department before selling. By listing on the Foodhall, Vendors represent and warrant that they are legally permitted to sell each item they list, and agree to indemnify and hold harmless Munchor Market from any claim arising out of their products, preparation practices, or legal non-compliance.

6. Reporting a concern

If you experience a food safety issue with a Foodhall order, contact the Vendor first, and please also report it to us via our Contact page so we can review the Vendor's standing on the platform. For suspected foodborne illness, contact your local health department.

Nothing on this page is legal advice. Vendors should consult a licensed attorney or their local regulatory authority regarding their specific obligations.
