Marketplace Terms & Vendor Agreement

Plain-language summary: Munchor Market is an online marketplace — a venue that connects independent local food creators (“Vendors”) with customers. We do not make, prepare, inspect, package, or deliver any food. Each Vendor is an independent business responsible for its own food, legal compliance, and customer service. By using this site as a customer or Vendor, you agree to the terms below.

1. Our role as a platform

Munchor Market (“the Platform,” “we,” “us”) provides technology that lets Vendors list, market, and sell food products, and lets customers discover and order from them. We are not a food establishment, food producer, caterer, or delivery service. When you place an order, your purchase contract for the food is between you and the Vendor fulfilling that order. Each Vendor's items are ordered and checked out separately, and the Vendor's information is shown on your order.

2. Vendors are independent businesses

Vendors are not employees, agents, partners, or representatives of Munchor Market. Vendors set their own menus, prices, preparation methods, hours, delivery areas, pickup locations, and refund policies. We do not supervise, direct, or control food preparation and we make no representation that any Vendor holds any particular license, permit, or certification.

3. Food safety and legal compliance (Vendor obligations)

Each Vendor agrees that it is solely responsible for:

  • Complying with all applicable laws, including state and local cottage food laws, health codes, permitting, licensing, labeling, and tax obligations;
  • Safe sourcing, preparation, storage, packaging, transport, and handoff of all food it sells;
  • Accurately describing every listing, including ingredients and the presence or possible cross-contact of major allergens;
  • Honoring posted hours, turnaround times, and its own refund/cancellation policy;
  • Maintaining any insurance appropriate to its business.

4. Customer acknowledgment — home-prepared food

Many items sold on Munchor Market are prepared by home cooks in home kitchens operating under cottage food or similar laws. These kitchens may not be inspected by a government food safety agency. By ordering, you acknowledge and accept this, and you agree to review each Vendor's listing information, including allergen notices. See our Customer Advisory for food safety guidance.

5. Payments and fees

Card payments are processed through the Platform's checkout; Vendor payouts are made after deduction of the Platform commission. Where a Vendor accepts cash or payment-app payment at pickup, that transaction is collected directly by the Vendor and the applicable commission is invoiced to the Vendor. Commissions and payout schedules are described on the Vendor Sign Up page and may be updated with notice.

6. Srvd Gigs bookings — platform payment and no circumvention

Srvd Gigs is the Platform's event-booking service. All Srvd Gigs bookings are additionally governed by the Srvd Gigs Booking Agreement, accepted by posting, bidding, or accepting a bid. For all gigs posted, bid on, or arranged through Srvd Gigs (or through contacts made on Srvd Gigs):

  • All booking payments must be made through the Platform. When a bid is accepted, the Platform issues the customer a payment invoice; the booking is confirmed only when that invoice is paid. The Platform collects the full booking amount and pays the Vendor in two releases — a 50% advance within 48–72 hours after the customer's payment clears, and the balance within 48–72 hours after event completion — less the 10% platform fee, as detailed in the Booking Agreement (timing subject to bank and payment-processor processing times).
  • Off-platform payment is prohibited. Vendors and customers agree not to solicit, arrange, or accept payment for a Srvd Gigs engagement outside the Platform (including cash, payment apps, or direct invoicing), and not to exchange contact information in bids or gig threads for that purpose. Doing so violates this Agreement and may result in removal of listings, forfeiture of pending payouts related to the circumvented booking, and suspension or termination of the Vendor account.
  • Protection applies only to platform payments. Payments made outside the Platform are not recorded, not protected, and entirely at the parties' own risk; the Platform has no obligation to assist with disputes arising from off-platform arrangements.
  • Gig postings, bids, and thread replies are subject to review and moderation, including removal of contact details and promotional content.

7. Cancellations, refunds, and disputes

Refund and cancellation policies are set by each Vendor and shown on their storefront. For Srvd Gigs bookings, the cancellation and dispute schedule in the Booking Agreement applies. Customers should first contact the Vendor for any order issue. We may, at our discretion, assist in resolving disputes, but we are not obligated to issue refunds for Vendor-fulfilled orders. 8. Disclaimer of warranties

THE PLATFORM AND ALL PRODUCTS SOLD BY VENDORS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND WE MAKE NO WARRANTY REGARDING THE QUALITY, SAFETY, LEGALITY, OR ACCURACY OF ANY VENDOR LISTING OR PRODUCT.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MUNCHOR MARKET AND ITS OWNERS, OFFICERS, AND STAFF WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, ILLNESS, ALLERGIC REACTION, OR PROPERTY DAMAGE ARISING FROM FOOD PREPARED, SOLD, OR DELIVERED BY A VENDOR. IN ALL CASES OUR TOTAL LIABILITY RELATED TO ANY ORDER IS LIMITED TO THE PLATFORM FEES WE RECEIVED FOR THAT ORDER. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Vendor indemnification

Each Vendor agrees to defend, indemnify, and hold harmless Munchor Market from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the Vendor's products, food preparation, listings, legal non-compliance, or breach of this Agreement.

11. Release

Because the food purchase contract is between customer and Vendor, customers release Munchor Market from claims arising out of disputes with Vendors, to the fullest extent permitted by law.

12. Content, suspension, and removal

We may review, suspend, or remove any listing, storefront, gig, bid, or account at any time — including for suspected safety issues, legal non-compliance, misrepresentation, payment circumvention, or repeated complaints — with or without notice.

13. Changes to these terms

We may update these terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance. Material changes for Vendors will be communicated by email or dashboard notice.
